PRIVACY POLICY

 This privacy policy aims to inform you about the protection of personal data used on the website www.solidmodular.es (the "Website") or the social media (“SOCIAL MEDIA”), which is owned by SOLID MODULAR, SL (“SOLID MODULAR”), so that you can freely and voluntarily decide whether to provide SOLID MODULAR with the personal data that it may require from you or that SOLID MODULAR may obtain from you in connection with your access to and use of the Website or the Social Media.

SOLID MODULAR firmly defends the importance of personal data security and User privacy, therefore, in accordance with the provisions of current legislation, SOLID MODULAR commits to adopting the necessary technical and organizational measures to ensure the processing of personal data in a lawful, fair, and transparent manner (“Privacy Policy”).

The Privacy Policy presented is subject to, and will be adapted as necessary due to legal modifications, the current Spanish and European regulations regarding the protection of personal data. Specifically, it complies with the following standards:

a)   Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (“GDPR”). 

b)  Organic Law 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights (“LOPDPGDD”).

(i)   DATA CONTROLLER

SOLID MODULAR informs you that your personal data provided on the Website or social media of the Company, as well as those indicated in inquiries or forms of SOLID MODULAR, will be incorporated into a record of processing activities owned by the data controller, in accordance with the provisions of the GDPR and other applicable legislation regarding the protection of personal data.

(ii)  PURPOSE

SOLID MODULAR will only have access to the personal data that the User voluntarily provides through any means used to interact with the Website or the social media of said Company.

In this regard, SOLID MODULAR informs that, in order to access certain services offered through the Website, the User will be required to provide personal data as well as to complete forms with mandatory fields, so that the omission of any of them may result in the inability to register on the Website, or to process their request or access or use the services and content offered through the Website. 

The User is also informed that SOLID MODULAR has created a profile on various social media platforms (LinkedIn and Instagram) primarily to advertise its products and services. 

In compliance with the provisions of the current data protection legislation, we inform you that, by accepting this Privacy Policy, the User agrees that their personal data will be processed by SOLID MODULAR for the following purposes: 

a)   Contractual purpose treatment

The User's personal data will be processed primarily for the purpose of managing and providing the products and services they have contracted with SOLID MODULAR. 

This processing is essential since, if it did not occur, SOLID MODULAR would not be able to manage the User's requests. Consequently, the fact that legitimizes this processing is the necessity of executing the existing commercial and contractual relationship between the User and SOLID MODULAR, specifically:

-  The provision of the requested services and information, offering SOLID MODULAR specialized advice;

-  The creation of user profiles, for the purpose of generating the requested budgets, as well as providing advice regarding the design and the product that may have been required.

b)  Treatment in order to fulfill a legal obligation

SOLID MODULARA is also legitimate to process the personal data of the User when they exercise some of the rights that protect them in the field of Data Protection, as it is necessary for the fulfillment of obligations in the area of data protection, specifically in the context of addressing the rights of the data subjects, in accordance with the provisions of Articles 12 to 22 of the GDPR and Articles 12 to 18 of the LOPDPGDD.

c)   Treatment for legitimate interest purposes

SOLID MODULAR processes the User's personal data based on legitimate interest to improve the efficiency and productivity of its activities, with the aim of being able to handle complaints and grievances in accordance with existing quality regulations..

Likewise, in order to promote its services, SOLID MODULAR will send the User news, offers, promotions, updates, and information, in general, about the products and services offered, which may be of interest according to their preferences, known through the analytical cookies used by the Website (See Cookie Policy), the interactions the User has had with the Website or on Social Media, as well as the products or services that the User has previously requested from SOLID MODULAR. Notwithstanding this, such actions will always be carried out in accordance with the legal requirements established in the GDPR, the LOPDPGDD, and also in Law 34/2002, of July 11, on information society services and electronic commerce..

However, the communications mentioned in the previous paragraph will not take place when the User has expressly indicated to SOLID MODULAR, via email to the address previously provided, their refusal to receive them; in which case SOLID MODULAR will remove the User's email from its mailing list.

d)  Treatment based on your consent

The User, at the moment they provide their personal data using the contact email of SOLID MODULAR that appears on the Website or by sending any form from the Website (whether to register on it, to make an inquiry, to request a product or service, or for any other purpose), will be expressly consenting to SOLID MODULAR to have access to their personal data, to store it, and to process it in accordance with the applicable GDPR and LOPDPGDD regulations.

(iii)  TYPE OF PERSONAL DATA

The personal data of the User that may be processed by SOLID MODULAR will be the minimum and necessary for the purposes previously indicated. Specifically, it will consist of identifying data, contact data, economic data, and personal characteristics, among others, which will be collected through the corresponding form.

(iv) QUALITY OF PERSONAL DATA

For SOLID MODULAR, it is important that the personal data provided by the User is accurate, truthful, and lawful, and that it is kept up to date in order to correctly offer the requested product or service. Therefore, the User is obliged to inform SOLID MODULAR of any changes that may have occurred in their personal data compared to what was communicated at the time.

Consequently, any inaccuracy or falsehood in the information provided will be the User's responsibility, and any incident during the installation of the requested product or service due to such inaccuracy or falsehood in the data provided by the User will exempt SOLID MODULAR from all liability, placing any additional costs that may arise on the User.

For the above reasons, SOLID MODULAR reserves the right to exclude from the services and products it offers, as well as to remove from its Website, Users who have provided false personal information.

(v)  DATA CONSERVATION

SOLID MODULAR will retain the personal data provided by the User for as long as necessary while the relationship between the User and SOLID MODULAR or the service being provided lasts. For commercial purposes, SOLID MODULAR will keep such data as long as the User does not express opposition to this or has not requested its deletion from the Company's database or requested the limitation of its use.

In the event that any of the aforementioned circumstances occur, SOLID MODULAR will proceed to delete the User's personal data, except for those that, in compliance with a legal obligation imposed on the data controller, must remain duly blocked until the time limit established by the applicable regulations.

(vi) DATA COMMUNICATION TO THIRD PARTIES

SOLID MODULAR will not transfer the User's personal data to third parties, unless it is necessary to achieve the proper execution of the services requested by the User, or when there is a legal obligation.

In any case, such communications of personal data will be carried out as a processing assignment by the third party to whom they should have been provided.

In this regard, SOLID MODULAR will enter into the corresponding data processing agreements with third parties that process or access personal data under the responsibility of SOLID MODULAR, in compliance with the provisions established in the GDPR and the LOPDPGDD.

(vii) PROACTIVE RESPONSIBILITY

SOLID MODULAR will maintain a Record of Processing Activities with information regarding the data processing it carries out in the context of its activities. This Record will be continuously updated.

Regarding security and protection, it is reported that the User's personal data will be processed lawfully, fairly, transparently, appropriately, relevantly, limited, accurately, and updated. Therefore, SOLID MODULAR is committed to adopting the technical means, level of security, and degree of protection that is legally required to prevent the loss, misuse, alteration, unauthorized access, and theft of such data.

(viii) EXERCISE OF RIGHTS

The User may exercise at any time the rights that will be indicated below, regarding their personal data:

a)   Right of Access: The right to know what data SOLID MODULAR is processing both on the Website and on Social Media. However, regarding Social Media, access will be defined by the functionality of the specific social network and the ability to access the information of user profiles.

b)  Right of revocation of consent: Right to withdraw consent to SOLID MODULAR for processing the provided personal data. This will result in the User's cancellation on the Website, given that without the User's consent to process their personal data, SOLID MODULAR will not be able to access it, which will make it impossible to contract any product or service and its proper execution.

c)   Right of rectification: The right for SOLID MODULAR to rectify, complete, or update the personal data previously provided, in the event that it is inaccurate.

d)  Right to object: Right to oppose the processing of the provided personal data. This will entail, on the part of SOLID MODULAR, ceasing to process the personal data of the User who has requested it, except for the defense of possible claims.

e)   Right to erasure: The right for SOLID MODULAR to delete the User's personal data from its database when the maintenance of such data is no longer necessary for the purposes for which it was collected. In this case, SOLID MODULAR will cease to process the personal data except for the exercise or defense of potential claims.

f)    Right to restriction: The right for SOLID MODULAR to limit the processing of personal data provided in the cases expressly indicated in the GDPR and the LOPDPGDD. If any of the anticipated situations occur, and the User has exercised this right, SOLID MODULAR may only process the personal data of the User in question with their consent, except for its retention and use for the exercise or defense of claims or for the protection of the rights of another natural or legal person, or for important public interest reasons of the European Union or a specific Member State.

g)  Right to portability: The right for SOLID MODULAR to provide the User with the data processed for the execution of products and services, as well as the data processed with their consent, so that they can transmit it to another responsible party when technically feasible.

The aforementioned rights may be exercised by sending a written communication in a reliable manner to SOLID MODULAR, SL, whose details are provided in the Legal Notice. Additionally, you may file a complaint with the national supervisory authority. For this purpose, you should contact the Spanish Data Protection Agency: C/ Jorge Juan, 6, 28001-Madrid.

(ix) VALIDITY AND MODIFICATION OF THE PRIVACY POLICY

The current Privacy Policy may be modified due to changes in the requirements established by the applicable legislation at any given time, by judicial decisions, and by changes in case law. When such changes are significant, they will be communicated to the user.
